The website Flygsupport.se is owned by HA Support AB, organization number 559468-9480, with address Bryggaregatan 1, 371 34 Karlskrona, Sweden. All services ordered through this website are provided by HA Support AB (hereinafter referred to as “Flygsupport” or “we”). Flygsupport will be your contractual partner for all services offered.
The following general terms and conditions apply to Flygsupport:

1. Subject Matter of the Agreement and Flygsupport’s Services

1.1
Flygsupport undertakes to pursue and enforce potential compensation claims (and, where applicable, other claims) against airlines on a performance basis under EU Regulation 261/2004 on air passenger rights or equivalent rules. This includes claims related to canceled, delayed, or overbooked flights (hereinafter referred to as “Claims”).
To pursue a Claim, and after we accept it, you must either:

  • Irrevocably assign your claim to us and grant us the right to pursue the matter further (“Assignment Process”), or
  • Grant us a power of attorney to act on your behalf (“Power of Attorney Process”).

Flygsupport primarily seeks to resolve Claims out of court and gathers necessary information from the airline.

If out-of-court measures are unsuccessful, we may engage an Assigned Legal Counsel for legal review of the Claim. Flygsupport bears all related costs if the claim is unsuccessful.

Information and services presented on our website (www.flygsupport.se), including compensation calculators, do not constitute a binding offer to enter into an agreement.

2. Formation of the Agreement

2.1
You initiate our services by using our compensation calculator and clicking “Start Claim.” This constitutes a binding offer to enter into an agreement with us. Flygsupport accepts your offer either via written confirmation (e.g., by email) or by initiating the claims process.
2.2
You are responsible for ensuring the information you provide is complete and accurate. Any changes to this information (e.g., contact details) must be communicated to us immediately.

3. Fees

3.1
Flygsupport charges a fee according to our current price list (hereinafter “Fee”). The Fee is only applicable if we successfully enforce the Claim.

3.2
The Fee amount depends on whether we engage an Assigned Legal Counsel. If resolved without legal action, the Fee is lower.

If the claim proceeds to court:

3.3
If only part of the Claim is successful, the Fee is calculated on the obtained portion.

3.4
If Flygsupport fails to enforce the Claim, you will not be charged any Fee.

4. Payment and Accounting

4.1
We deduct our Fee before compensation is paid to you.

4.2
Upon receiving payment from the airline, we settle and transfer your share to the account you provided.

4.3
Any bank fees for international transfers are your responsibility.

5. Your Obligations

5.1
You must cooperate with Flygsupport by providing necessary documentation (e.g., boarding passes, booking confirmations).

5.2
If you receive payment directly from the airline, you must notify us immediately.

5.3
During the term of the agreement, you may not engage others to pursue the same Claim.

6. Engagement of Legal Counsel

6.1
Flygsupport may engage an Assigned Legal Counsel for legal actions. We cover all costs.

6.2
You must cooperate with the Assigned Legal Counsel and respond to inquiries.

7. Right of Withdrawal

You may withdraw from the agreement within 14 days without providing a reason.

8. Affiliate Program

8.1 Approval of Application
Flygsupport reserves the right to approve or reject your application to the Affiliate Program at its sole discretion. Decisions are final and not subject to legal recourse.

8.2 Commission Terms

  • Commissions are paid monthly after referred claims remain active for at least 31 days.
  • Self-referrals or commissions on your own accounts are prohibited.
  • No payouts for refunds/chargebacks.

8.3 Termination of Agreement
Your participation may be terminated immediately for:

  • Misleading advertising/spam
  • Promotion on websites with illegal content
  • Failure to disclose affiliate links per FTC guidelines
  • Infringement of intellectual property rights
  • Unauthorized rebates/bonuses from your commission
  • Suspected fraud/self-referrals

8.4 Marketing Guidelines

  • Use only approved text/graphics or your own compliant materials.
  • Classified ads, emails, and print media require prior consent.

8.5 Coupons and Offers

  • Only pre-approved affiliates may promote specific coupon codes.
  • Bidding on keywords like “Flygsupport discount” in ads is prohibited.
  • No cookie tracking via popups/iframes without explicit user action.

8.6 Pay-Per-Click (PPC) Policy
Written permission from Flygsupport is required before launching PPC campaigns.

8.7 Liability and Risks
Flygsupport is not liable for:

  • Indirect damages (e.g., lost commissions)
  • Technical tracking errors
  • Website downtime

8.8 Term of Agreement
Effective upon program approval until termination. Continued participation implies acceptance of updated terms.

8.9 Indemnification
The Affiliate agrees to indemnify Flygsupport against damages caused by:

  • Breach of this agreement
  • Misleading marketing
  • Failure to comply with laws

8.10 Electronic Signatures
By registering for the program, you accept this agreement as a legally binding electronic signature.
